Does a property need to be owned free and clear before putting it in a land trust? I took occupancy of my recently deceased fathers home and need to obtain a mortgage for the balance after paying off what he still owed but have yet to transfer the title to my name. May I transfer the title directly to a land trust from his name (or his “estate”) or will a new mortgage require I have the title in my own name first?  My goal being privacy and asset protection from my ex-husband.
