How would I convince a potential person to be a trustee to assure them that there is no luiability or exposure to the individual? For example, if someone searched the co. property site in order to bring a lawsuit or other action against the property at our address. It would show that the trustees name was the deed holder. Then they could look up that persons name to attempt to sue or otherwise harass.
Frank, one of the many forms available for my students is a letter I have written to convince someone to become your Trustee. You will find that letter in the Land Trust University (LTU). While it is true that if someone attempts to sue a Land Trust, they would have to start with serving the Trustee. While the Trustee has NO personal liability, this is designed to bring the Trustee to court to disclose who the Beneficiary is because the liability on the property held in the trust flows through to the Beneficiary (this is why most of my students make an LLC or Corporation the beneficiary of their Land Trust(s). This process assumes that you can find the Trustee to serve (only a fool would put the Trustee’s address on a deed…only a P.O. Box address should be used).
